Abbas and the Palestinian Authority - Continue to deny Israel's 3000 years of history

  Date Posted: 2012-05-18 17:06:25 - VIRTUAL JERUSALEM

Abbas: Jerusalem Only Has Islamic & Christian History

PA Chairman Mahmoud Abbas and the Palestinian Authority continue to deny Israel's 3,000 years of history in Jerusalem, claiming it is solely an Arab, Muslim and Christian city. Earlier this month, Abbas referred to Israel's presence and activities in Jerusalem as "Judaization" and stated that Israel is stealing what he called the "cultural, human, and Islamic-Christian religious history."

Last month, Abbas' advisor for Jerusalem said that Israel is trying: "to create an artificial heritage with a Jewish spirit at the expense of its true and authentic [identity] as an Arab, Islamic and Christian city."

This is not the first time that Abbas has denied Jewish history in Jerusalem and claimed the city for Islam alone. Palestinian Media Watch has reported that Mahmoud Abbas said that taking Jerusalem from Israel is a religious Islamic obligation of the highest level, a "fard ayn" - a personal Islamic commandment incumbent on every Muslim:

"I say to the leaders of our Arab nation and to its peoples: Jerusalem and its environs are a trust that Allah entrusted to us. Saving it [Jerusalem] from the settlement monster and the danger of Judaization and [land] confiscation is a personal [Islamic] commandment [Arabic: fard ayn] incumbent on all of us. Therefore, I call all of you to serious and urgent action to save [Jerusalem] and to make available all possibilities in order to strengthen our resolve and to maintain its historical, cultural and religious character."
[Al-Jazeera TV, March 27, 2010]

In a different speech, Abbas said in 2010:
"The oppressor will not last in Jerusalem; the oppression will not endure. Victory will come, Allah willing. This land is Allah's best land, for which He chooses the finest of His believers, as it is written in the words of the Prophet [Muhammad]."
[Al-Hayat Al-Jadida, July 11, 2010]

Abbas' Minister of Religion Mahmoud Al-Habbash claimed that Jerusalem has been:
"throughout history, the capital of the Palestinian state and the capital of the Palestinian people."
[PA TV (Fatah), Aug. 20, 2010]

Neither claim is correct. There has never been a Palestinian state and Jerusalem was never the capital of an Arab or Muslim state. Nonetheless, the minister warned there would be religious war over Jerusalem:
"The term 'war' cannot be erased from the lexicon of this region as long as Jerusalem is occupied."

[PA TV (Fatah), Aug. 20, 2010]

The Palestinian Authority Mufti Muhammad Hussein likewise recently denied Jewish history in Jerusalem:
"They [Jews] want to say or suggest that this place (i.e., the Temple Mount) was once, according to their claim, a Temple. However, in truth, there never was a Temple in any period, nor was there, at any time, any place of worship for the Jews or others at the Al-Aqsa Mosque site (i.e., which was built on the Temple Mount, 705 CE)."

[PA TV (Fatah), Jan. 5, 2012]

The following are the recent statements by Mahmoud Abbas and his advisor on Jerusalem, followed by Abbas' earlier comments and the remarks of the Minister of Religion:

"President Mahmoud Abbas held a series of meetings in Tunis... the President met with the Arab ambassadors to Tunisia... He explained to the guests the policies that are being adopted by the occupation authorities (i.e., Israel) - Judaization, destruction of homes, causing the emigration of Palestinian inhabitants, and imposition of high taxes; the continued excavations under the Al-Aqsa Mosque; [and he explained] the need for Arab cohesion in order to protect what remains of the holy city, and the [Israeli] attempts to steal its cultural, human, and Islamic-Christian religious history.
"
[Al-Hayat Al-Jadida, May 1, 2012]

"Advisor on Jerusalem affairs to the Palestinian President's Office, Ahmed Al-Ruweidi... said: 'Israel is managing to seize the land in the city; at the same time, the chances of maintaining its Arab and Islamic identity are small, since the occupation authorities are carrying out the 2020 plan, which is meant to establish the Jewishness of Jerusalem and to create a new and fabricated facade with an artificial heritage... about Jewish existence in Jerusalem... It is not befitting a city with the importance of Jerusalem, with what it represents, that it should continue to be subject to occupation... and that there should be repeated, ongoing attempts to change its geographical, demographic and cultural characteristics, and to create an artificial heritage with a Jewish spirit at the expense of its true and authentic [identity] as an Arab, Islamic and Christian city.'"
[Al-Hayat Al-Jadida, April 25, 2012]

Mahmoud Abbas, addressing the leaders of Arab countries at the Arab League summit in Libya, on March 27, 2010:

Mahmoud Abbas"I say to the leaders of our Arab nation and to its peoples: Jerusalem and its environs are a trust that Allah entrusted to us. Saving it [Jerusalem] from the settlement monster and the danger of Judaization and [land-] confiscation, is a personal [Islamic] commandment [Arabic: fard ayn] incumbent on all of us. Therefore, I call all of you to serious and urgent action to save [Jerusalem] and to make available all possibilities in order to strengthen our resolve and to maintain its historical, cultural and religious character."

Mahmoud Al-Habbash, PA Minister of Religious Affairs with Mahmoud Abbas in the audience:

"Jerusalem is not just a city. Al-Aqsa is not just a mosque. Jerusalem is the key to peace, and Jerusalem can ignite a thousand and one wars. Unless the issue of Jerusalem is solved, so that it returns to its owners; unless Jerusalem will be Palestinian, as it was throughout history, the capital of the Palestinian state and the capital of the Palestinian people, the place which is the object of heartfelt longing and which all Muslims aspire to reach; unless Jerusalem is like that way, there is no peace. There is no peace without Jerusalem. There is no stability without Jerusalem. If Jerusalem is dishonored, if Jerusalem is disgraced, if [Jerusalem] is lost, it may leave the door open to all possibilities of struggle, all possibilities of war. The term 'war' cannot be erased from the lexicon of this region as long as Jerusalem is occupied, as long as Jerusalem is disgraced, as long as the residents of Jerusalem are being targeted. It's not possible; Jerusalem has to return to its owners. And we are its owners."

Newest Birther Revelation, newest coverup

GRUMPY'S OPINIONS
Earlier today Breitbart.com announced during the vetting they had uncovered a pamphlet went back to 1991 Obama’s publishing agent Acton & Dyste. The President’s Bio said that
Breitbart News has obtained a promotional booklet produced in 1991 by Barack Obama’s then-literary agency, Acton & Dystel, which touts Obama as “born in Kenya and raised in Indonesia and Hawaii.”
The booklet, which was distributed to “business colleagues” in the publishing industry, includes a brief biography of Obama among the biographies of eighty-nine other authors represented by Acton & Dystel.
It also promotes Obama’s anticipated first book, Journeys in Black and White–which Obama abandoned, later publishing Dreams from My Father instead.

It didn’t take long for the cover-up start after Breitbart.com released a 1991 promotional booklet produced by the agency, Acton & Dyste advertising booklet  that strongly indicated someone had told the company that Barack Obama was born in Kenya. Within a couple hours ABC news was reporting this from By Dylan Stableford at Yahoo!.
A possible source of the so-called “birther” issue–or at least a potential cause of the rumors that have dogged President Barack Obama–has been identified.
Obama’s former literary agency misidentified his birthplace as Kenya while trying to promote the then-Harvard Law grad as an author in 1991.
According to a promotional booklet produced by the agency, Acton & Dystel, to showcase its roster of writers, Obama was “born in Kenya and raised in Indonesia and Hawaii.”
Miriam Goderich edited the text of the bio; she is now a partner at theDystel & Goderich agency, which lists Obama as one of its current clients.
“This was nothing more than a fact checking error by me–an agency assistant at the time,” Goderich wrote in an emailed statement to Yahoo News. “There was never any information given to us by Obama in any of his correspondence or other communications suggesting in any way that he was born in Kenya and not Hawaii. I hope you can communicate to your readers that this was a simple mistake and nothing more.
It sounds good, but how many people can remember how they dealt with a specific, routine job detail 20 years ago, they just happen to be a little bit out of the norm?
Miriam Goderich’s answer brings up several questions.
Where did she get the idea that Obama was born in Kenya? It would seem reasonable to me that if you going to write a bio about someone you simply call them and ask them the pertinent questions. Little things like were you born, in most cases, that would mean what city or what state. Obviously someone provided her with some basic information, it seems strange that his birthplace was omitted from the basic information.
Standard practice would be to have the client proof the information so that any mistakes can be corrected before something goes into print. Unlike today’s computers where minor mistake can be fixed with a few mouse clicks, back in the days of printing presses you were stuck with what you published.  The only alternative was for someone to pay to produce the product twice.  Paying both the flawed original and the reprint.  There would’ve been nothing salvageable out of the first printing.  Everything would have to be redone from scratch, set up, labor, and a whole projects worth of paper and ink.  Printing companies were meticulous about getting sign offs and approvals and they triple checked everything before it went to press. It is possible that this just happens to be a  mistake, but the odds are remote.
In fact the odds of it being a mistake are just about as remote as the odds against the American people finding out for sure if it’s a mistake or not. There is more than enough questionable stuff in Barack Obama’s background to justify investigation. The media can find out that Romney gave the kid a haircut 45 years ago but can’t seem to find it anything of substance about Barack Obama.
Something ain’t right..
Bee's Note:
Something hasn't been "right" since the day America voted Obama into Office.
America will need an entire new dictionary after Obama is voted out of office November 2012.  Not in my lifetime has a group of people been called "birthers" - an identity pinned on Americans who question where Obama was born.  And, they question how a man could be "President of the U.S." when both his parents were NOT American citizens.  They wonder why the media did not vet this man before falling down to worship him.  How is it that Obama was allowed to campaign for the highest office in the land, given approval by the Democrat Party, without FIRST presenting his records, such as, college transcripts, birth certificate, and all documentation that would reveal this man's background?  He wrote two books about himself and apparently, that was "good enough" to get him into the White House.
An autobiography is not going to be as truthful as a biography written by a third party.  If I write a book about my life, I can guarantee it will be flowing with good things about myself and all those mistakes and hidden ghosts in my closet will be left out of that book.  After all, why would I inform the world about things in my past that I'm not proud of doing?  And, who writes two books about themselves, BEFORE ever doing anything in life that contributed to the betterment of this world?  Let me guess.  A man who is being primed for the White House, by his mentors, would have assistance in writing autobiographies for future reference, when Americans began asking questions about this man's past.  All that is needed is one "good" book - forget about seeking information about the man's' past through paper trails and legal documentation.
As I told my friend Grumpy earlier today, I don't care if Obama was born in a frog pond, or shipped to the USA by way of a flying saucer.  The issue today is not about his birth, as he already slipped through the cracks four years ago.  Today, the issue is what he has done since entering the White House.   Congress has low approval ratings because they have given this man free reign to ignore the U.S. Constitution; allowing him to  by-pass Congress; passing Executive Orders whenever it suits him;  forcing the United States to accept the friendships of questionable organizations and countries, while ignoring and mocking long-standing allies of the United States; suing individual states of America; giving terrorists organizations, such as, the Muslim Brotherhood, giving them legitimacy by inviting them to the White House for a cup of tea; allowing the PLO/PA flag to fly on American soil in Washington, DC, when this organization is responsible for bombing Israel; hiring over 35 Czars, many with criminal and/or questionable backgrounds (like himself); and, while the list is endless, there is more to come if re-elected, as he promised the Russian president he (Obama) would be more "flexible" when he is re-elected.  Does Congress have a clue what Obama meant when speaking to the Russian on an "open" mic?!
TRILLIONS OF DOLLARS in debt; a healthcare plan that now sits in the Supreme Court, for yet another "questionable" non-Constitutional plan of Obama's; worst economy since the Great Depression; Americans out of work, losing their homes, and the cost of bread rising higher than a package of active yeast.
Let me ask one question.  Why did Obama and Michelle both turn in their law licenses?  As any attorney will tell you, it takes years of study to pass a law exam.  Having worked for attorneys in the past, I could share some stories of their financial sacrifices, burning the candle at both ends studying and working part time jobs in order to reach their goals.  If an attorney decides to change professions in mid-stream, they maintain their law license - they don't turn it in, as they worked too hard for it and may decide to return to law at some later date.  I also know that normally, when someone is forced to turn in a license, it usually means they were found guilty of either lying or, to avoid a lawsuit from a Complaint filed by a client, etc.  I'm not saying this is what happened to the Obama, but considering the many actions by Obama since he graduated from Harvard should raise white flags!
Everyone has their own list of issues that are a continuation of Obama policies that lead America on the wrong path; those issues far out-weigh the unanswered questions of Obama's background.  When one looks at what Obama has done these past 4 years, there is no need to seek answers from a belated background check - America, we have our answers!
Our answers are in the playboy-style, Hollywood wanna-be, lavish spending and vacations, of the Obama family, at the expense and on the backs of America.  Let's put an end to this charade in November.

3 Simple Ways to Turn Your Website Archive into Profitable Books and eBooks

Attention Bloggers: I’ve seen the future, and you’re missing it.
Oh sure, we bloggers think we’re the most up-to-date, leading-edge, tech-savvy people on the planet.
But one of the biggest changes in the long history of content creation is taking place right under your feet, and I’m afraid it may be passing you by.
Yep, the ground is shifting, fortunes are being made, and some of the people who could best profit from this tectonic shift — content producers — are mostly sitting on the sidelines.
Okay, what am I talking about? The revolution in book publishing …
Maybe you’ve heard some of the success stories of the authors who’ve been selling a ton of paranormal romances, thrillers or other genre novels on Amazon’s Kindle platform, but that’s notwhat I’m talking about.
You may have also heard about big-time authors like Barry Eisler, Steven King, Seth Godin and others leading the way in self-publishing. That’s not it either.
What I’m talking about is something bloggers are already expert in: niche publishing.

Bloggers vs. authors

Let’s back up for a minute. Have you ever thought about the similarities between self-publishing and blogging? Probably not, why would you?
But as a blogger who writes about indie book publishing, I think about this stuff all the time. And here’s what I see at this amazing moment in publishing:
Self-publishers and bloggers each have only half the equation for success in the new world of book publishing.
Take authors for example. Most are really good at things like producing long content (long as in 80,000 words), staying with a project for months or years without losing focus, and planning a complex project using freelance contractors.
The problem is, many authors are notorious loners, are often non-technical, they can go years without any contact with their readers, and their mindset may be completely rooted in the 19th century. Not only that, the typical author has no idea of what marketing actually means in the real world.
That might make a blogger feel pretty good about herself.
It’s true that bloggers stay in constant touch with their readers, know how to publish on a schedule, get constant feedback from readers, love to experiment via agile content, and are highly networked with other bloggers in their niche.
But niche market bloggers have obstacles to overcome, too.
They can fall into the trap of thinking 500 words at a time, with disjointed subjects littering their archives. After blogging for a while, they may lose sight of any overarching theme they started with.
Not only that, many bloggers treat their blogs as a “hobby”, or they’re focused on Adsense, affiliate sales and special promotions. Bloggers like to chase the “shiny new object,” fall into the social media time-sink very easily, and all too often rely exclusively on metrics as the measure of their success.

Why book publishing makes sense for bloggers

Here’s what you’ve been missing: you don’t have to be Amanda Hocking or Joe Konrath or John Locke (all of whom have sold a ton of ebook fiction) to get major, potentially life-changing results from book publishing.
This is the dirty little secret behind self-publishing that we’ve been hiding from the big publishers for years:
If you’re a writer with ready access to a niche audience, you’re probably much better off financially publishing your own book.
If you blog on a niche topic and know how to reach the people in that field, why give 85% of your profits to a big publisher in New York?
(If you’re Chris Brogan or Tim Ferriss writing for a mass consumer or mass business market, youmight be better off with that big publisher. But if that’s not you, read on.)

Can Cyber Criminals Exploit Postings on Facebook and Twitter?

FAMILY SECURITY MATTERS
by MITZI PERDUE May 18, 2012
Supposing it was you who put up this innocent-looking Facebook post. That post would be guaranteed to worry Mark Herschberg, an MIT-trained cryptographer. As a New York-based cyber-security expert and CTO, he would find a number of causes for concern since he knows that women are particularly vulnerable to misuse of information used in social media.

"Your Facebook/Twitter status and photos say a lot about you," he says, adding, "A determined person may already have found out that you're a women, learned where you live and whether you live alone. With that post, the bad guy now knows that you're not home. That post could set you up for a robbery or even a physical attack."

He goes on to say, "On top of that, the bad guy also knows it's your birthday, and if he's a determined cyber-criminal, this could help him hack your identity."
Identity theft is a serious issue for women. According to the Affinion Security Center, 17% percent of female identity theft victims have lost $1,000 or more due to the crime, versus only 10% of males.

If you were talking with Mark about this, you might answer him, "But I keep my Twitter and Facebook accounts private. Why should I worry?"

His answer: "Even if you have your privacy settings set to friends of friends, some of those friends might be easy-going and accept all friend requests, and now you have a hole in your security. Cybercriminals are out there, looking to exploit those kinds of holes."

Herschberg also warns about a new tactic used by cybercriminals to exploit your social media information: spear phishing.    Unlike traditional spam, spear phishing is highly targeted, and the sender may impersonate a friend or colleague while creating a message using details that apply specifically to you, details he or she learned from your social media accounts.  The message may invite you to a conference on a topic that interests you, or ask you to check out a report on a topic they've learned is important to you. The goal is to get you to click on an infectious attachment or visit a malicious website so the cybercriminals can get sensitive information such as passwords. He recommends contacting your friend or associate to ask if they really did send the e-mail.

Jody Westby heads Global Cyber Risk, a cyber security company in Washington, DC. She agrees about the dangers of putting information on line, and since she knows that women are most often the ones who talk with and train their children about on-line safety, she wants women to be vigilant on behalf of their children. "Today children need to know not to give out their full name, or where they go to school, or their phone number when online unless they know the person."

Brian Krebs, an internet security journalist in Washington, DC, says beware of financial risks lurking in sudden, strange messages. "A hallmark of a malicious program," he says, "is, they try to get you to act quickly." For example, "Your credit card has expired. Click this link immediately or we will cancel your account."

Krebs recommends, "If you get an e-mail that purports to be from your bank and asks for information, or asks you to click a link and log in, it is very often a scam or a trap. If you have questions about whether one of these email addresses a real problem, call your financial institution. Do not reply to the message or take any other action!"

It's never a good idea to respond to spam, but if it comes from your friend or family, it can be tricky. It might be real; it could mean their account was hacked.
So pause when you get e-mails that seem to come from a friend or relative or co-worker with short messages like, "Hey, check out this movie I saw, it's really funny," or "OMG! There's a video of you posted online that's awful!" or "Check out the attached file!"
Like Herschberg, Krebs recommends writing back and asking, "Did you send this?"
Krebs predicts that in a disconcerting number of cases, the intent of the message wasn't at all friendly.
He also cautions against forwarding chain letters of the sort that tell you something wonderful will happen if you forward it to 10 of your friends. Chain letters are often generated by spammers as an exceptionally effective way for them to harvest current addresses. The chain letters are carefully worded to touch your heartstrings or religious or political beliefs, but don't forward them unless you're wishing more spam on yourself and your friends.

Chain letters that have PowerPoint presentations of, for example, irresistibly beautiful scenes from China or scantily clad ladies from Russia, may have hidden behind them malicious programs that can take control of your computer.

Almost everyone in cyber security says to exercise extreme caution when opening attachments or clicking links. As Krebs says, "It may be good for instant gratification, but it can also be good for an instant bad day."

 Additional Advice
1. Change your passwords every 90 to 180 days.
2. Don't use the same password for different accounts. If someone is able to crack one password, you don't want him or her able to attack all your accounts.
3. Choose passwords that have a combination of numbers and upper and lower case letters. (One lady at the Fifth Avenue Apple Store in Manhattan uses the address of her dog's vet preceded by her first boyfriend's initials, so it comes out something like this: BAF348W94th. Three months later, she'll change it to her dentist's address and still later, she'll use the address of a local restaurant.)
4. Be careful about using passwords on public computers, which could have spyware or key loggers installed on them.
5. Keep all your software up to date, especially JAVA, which is a vector for malware.
6. If you have an iPhone or an iPad, activate their password protection. There are thieves in major cities who specialize in targeting people with iPhones or iPads in order to harvest information to sell to identity thieves.
Assuming you have virus protection software, you're part way to cyber security, but your computer with software protection is like a castle surrounded by a mote. The software can protect you, but not if you lower the drawbridge and open the castle gate.

Every parent should post this report on the wall, next to the computer their child is using, as a clear WARNING when using their computer.  Grandparents should do the same!
Years ago, I gave permission to my young teenage grandsons the use of my computer.  They were searching music videos and new games on the Internet.  Later that same day, after the boys went home, I went upstairs, fired up the computer (or tried to..!), and the computer was not cooperating with my commands.
I won't bore you with all the details, but will say it took a technician to help me fix the computer.  The computer had a major virus, not to mention numerous types of malware.
At the time, I thought I had the best virus and security maintenance programs money could buy!  It only took downloading of music and entering a certain game site to cause damage to my computer.  Today, problems with hackers and security, especially for the safety of our children due to the social media, such as Facebook, is more serious an issue for anyone using the computer.
The advice given in this report could save much grief, but I would add that a parent should be in the room when a young teenager uses the computer.

Muslim group CAIR urges Kansas governor to allow sharia law

CREEPING SHARIA

It passed the House 120-0 and now the Senate 33-3. Terror-linked CAIR is pressing Kansas’ governor to permit sharia law in Kansas. via CAIR: Kansas Governor Asked Not to Sign Anti-Sharia Bill
WASHINGTON, May 15, 2012 /PRNewswire-USNewswire/ — The Washington-based Council on American-Islamic Relations (CAIR) today called on Muslims and all other Americans who value civil liberties to contactKansas Governor Sam Brownback to ask that he not sign a bill (House Substitute for Senate Bill 79)
KANSAS CITY, Kansas (Reuters) – Kansas lawmakers have passed legislation intended to prevent the state courts or agencies from using Islamic or other non-U.S. laws in making decisions, a measure critics have blasted as an embarrassment to the state.
Critics? Hamas-linked, FBI-banned, IRS-revoked, DOJ-confirmed unindicted co-conspirators to the largest terrorist financing conviction in U.S. history – those are your critics! When will the media do its &*#)ing job?
The legislation, which passed 33-3 in the state Senate on Friday and 120-0 previously in the House, is widely known in Kansas as the “Sharia bill,” because the perceived goal of supporters is to keep Islamic code from being recognized in Kansas.
The bill was sent to Republican Governor Sam Brownback, who has not indicated whether he will sign it.
In interviews on Saturday, a supporter of the bill said it reassured foreigners in Kansas that state laws and the U.S. Constitution will protect them. But an opponent said the bill’s real purpose is to hold Islam out for ridicule.
Kansas Representative Peggy Mast, a lead sponsor of the bill for the past two years, said the goal was to make sure there was no confusion that American laws prevailed on American soil.
Mast said research showed more than 50 cases around the United States where courts or government agencies took laws from Sharia or other legal systems into account in decision-making.
Commonly, they involved divorce, child custody, property division or other cases where the woman was treated unfairly, Mast said.
“I want people of other cultures, when they come to the United States, to know the freedoms they have in regard to women’s and children’s rights,” said Mast, a Republican. “An important part of this bill would be to educate them.”
Roughly 20 states have considered legislation similar to what has passed in Kansas, said Ibrahim Hooper, spokesman for the Council on American-Islamic Relations in Washington. Some state legislatures, including Kansas, have passed laws that do not mention Sharia by name, he said.
Hooper said there was a movement by conservative-leaning state legislatures to introduce anti-Islam bills that have no legal foundation.
“Really, the goal seems to be (to demonize) Islam and (to marginalize) American Muslims,” Hooper said. “Some (states) have passed these watered-down bills and declared a great victory. It’s utter nonsense, but if your goal is to promote intolerance, I guess you won.”
And if Allah is your objective, the Prophet is your leader, the Qur’an is your law, jihad is your way, and dying in the way of Allah is your highest hope – then there is no place for you in the United States and you must be stopped. We won’t let you win.
The Kansas City area is a hotbed of Hamas support with a growing Islamic problem as we’ve noted many times.

DEFENSE AMENDMENT AIMS TO GRANT TERRORISTS LEGAL RIGHTS

THE WASHINGTON FREE BEACON  BY:  -

DEFEATING NATIONAL DEFENSE

Screen Shot 2012-05-16 at 2.08.10 PM
Former government attorneys and defense experts fear that foreign terrorists could capitalize on a new House proposal that would afford them full protection under the U.S. legal system, potentially spurring a domestic influx of would-be terrorists who may seek to exploit the legal loophole.
The amendment, spearheaded by Reps. Justin Amash (R., Mich.) and Adam Smith (D., Wash), would implement an unprecedented reversal in longstanding U.S. policy by requiring that terrorists be prosecuted in civilian courts—a shift that would also allow them to be housed among general inmates in American prisons.
The amendment would prevent the president from effectively fighting the war on terror, thereby posing a serious threat to the country’s national security, experts warn.
“In order to be able to successfully fight and win this war, we need to support the notion that this is a real war,” said David Rivkin, who provided legal counsel in the administrations of Presidents Ronald Reagan and George H.W. Bush. “Anything that delegitimizes the laws of war is a horrible thing symbolically in terms of undermining a fragile consensus.”
Smith and Amash, Rivkin said, are unraveling a delicate legal balance that permits the president to effectively “fight and win” the war on terror.
“It is bad symbolism and would have bad policy consequences,” said Rivkin, who is currently a litigator at the D.C.-based Baker Hostetler law firm. “It is extremely jarring and bad that you have the Tea Party and the libertarian wing of the Republican party challenging with gusto the same aspects of national security policies like the left did” when George W. Bush was president.
In an effort to ensure that their amendment becomes law, Smith and Amash have engaged in what observers characterize as a deceptive fear campaign meant to coerce the public into supporting their proposal.
The lawmakers—as well as organizations such as the American Civil Liberties Union—have claimed that under current regulations American citizens with no affiliations or ties to al Qaeda could be detained indefinitely without trial.
Current law “doesn’t prevent the government from snatching Americans from their homes based on accusations that they’ve ‘substantially supported’ forces ‘associated’ with terrorists,” Amash recently wrote in a dear colleague letter. “It does nothing to stop the government from locking them up for the rest of their lives.”
Regulations currently on the books clearly shield both rights for American citizens, however.
“The Smith-Amash language is about fear, not fact,” said one senior Capitol Hill aide who is knowledgeable about the plan. “It’s a perverse encouragement for terrorists to attack us here at home, where they’d get legal protections.”
The duo aims to “gives terrorists better legal protections than our troops,” added the source.  “A soldier who commits a crime gets thrown in the stockade. A terrorist gets a federal judge.”
Smith and Amash are set to offer their plan as an amendment to the fiscal year 2013 National Defense Authorization Act (NDAA), a critical piece of legislation that allocates the Defense Department’s yearly expenditures. If the controversial language is attached, the essential bill could stagnate as members debate the dangers of affording terrorists greater legal protections.
Establishing such roadblocks in the war on terror could have deadly consequences, according to high-profile lawyers who recently came out against the amendment.
“Rewarding terrorists with greater rights for making it to the United States would actually incentivize them to come to our shores, or to recruit from within the United States, where they pose the greatest risk to the American people,” the experts wrote in a letter to Rep. Howard “Buck” McKeon, chairman of the House Armed Services Committee. “Such a result is perverse.”
The longtime experts—among them Rivkin, former Secretary of Homeland Security Michael Chertoff, and former U.S. Attorneys General Edwin Meese and Michael Mukasey—explained that tough detainee policies will become more critical as U.S. forces prepare to depart Afghanistan.
Questioning the constitutionality of the Amash-Smith language, the experts went on to label the lawmakers’ arguments as far-fetched.
“We find the notion propagated by some, that a citizen who has nothing to do with al Qaeda could be picked up off an American street and detained by the military, to be ridiculous,” they write.
Previous incarnations of the country’s wartime detainee policy have explicitly stated that the law should not be interpreted as a negation of any American citizen’s rights.
Libertarian hero and former Republican presidential candidate Ron Paul came out today in support of the Amash-Smith amendment. A handful of other congressmen have stated their support of the amendment, including Howard Berman (D., Calif.), Jeff Duncan (R., S.C.), John Garamendi (D., Calif.), John Duncan (R., Tenn.), Hank Johnson (D., Ga.), Paul Gosar (R., Ariz.), Mazie Hirono (D., Hawaii), Sheila Jackson Lee (D., Texas), Scott Tipton (R., Colo.), and Raul Labrador (R., Idaho.).
Republican leaders in the House are currently offering an alternative amendment to the NDAA that would clarify the existing law.
“We ask that you oppose Ranking Member Smith and Representative Amash’s amendment,” Reps. Scott Rigell (R., Va.) and Jeff Landry (R., La.) wrote in a recent letter to their colleagues. “The Smith-Amash amendment would apply to foreign terrorists like the Underwear Bomber, would interfere with U.S. Supreme Court precedent, and the inherent rights of any nation during a time of war.”
“We must ensure,” they add, “that we do not weaken our nation’s defenses against the foreign terrorist organizations who seek to deprive us of our life and liberty.”
The Obama Administration, in a statement released yesterday, threatened to veto the NDAA.
